WorkSafe has won a long legal fight to take the fishing company Talley's to court over an accident which paralysed an employee.
Te Atatū Hēmi, was left a paraplegic when a bulk bin fell off a forklift on to her at a processing plant near Ashburton in May 2015.
Talleys was charged by WorkSafe with failing to take all practicable steps to ensure Ms Hemi's safety.
At first the charge was dropped in the District Court, because of a problem with the charge sheet.
WorkSafe challenged that and won in the High Court and the Court of Appeal.
A further attempt by Talleys to have the charge dropped was then taken to the Supreme Court, which has dismissed the application for an appeal ending a three year legal battle.
